Information for Parents: Your school-aged children may qualify for certain rights and protections under the Federal McKinney-Vento Act. Eligibility is determined case-by-case.

McKinney-Vento Act

Section 725(2) of the McKinney-Vento Act defines “homeless children and youths” as individuals who lack a fixed, regular, and adequate nighttime residence. The term includes—Children and youths who are:

  • Sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason (sometimes referred to as “doubled-up”);
  • Living in motels, hotels, trailer parks, or camping grounds due to lack of alternative adequate accommodations;
  • Living in emergency or transitional shelters; or abandoned in hospitals;
  • Children and youths who have a primary nighttime residence that is a public or private place not designed for, or ordinarily used as, regular sleeping accommodations for human beings;
  • Children and youths who are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings; and
  • Migratory children who qualify as homeless because they are living in circumstances described

  • This form MUST be filled out annually, so please fill it out each year so that your eligibility can be reviewed each year.  

Services & Opportunities

Children and youth in transitional situations are eligible for support/services.  Those supports may include:

  • Transportation
  • School supplies
  • School Activities and Field Trip Fees
  • Tutoring
  • Case Management and referral services
  • Mental Health Counseling

Foster Care

  • Children and youth are protected under the Every Student Succeeds Act of 2015 (ESSA)
  • Foster Care is defined as 24-hour substitute care for all children placed away from their parents or guardians and for whom the child welfare agency has placement and care responsibility
  • Includes placements in foster family homes, foster homes of relatives, group homes, emergency shelters, residential facilities, child care institutions, and pre-adoptive homes
